Convenant over de bescherming van persoonsgegevens en waarborgen voor de zorgvuldige omgang met Persoonsgegevens die worden verwerkt in het kader van het gebruik van Digitale Onderwijsmiddelen door Onderwijsinstellingen, waaronder het gebruik van digitale leermiddelen, toetsen, administratie- en informatiesystemen.
Goed omgaan met privacy in het onderwijs. Dat doe je niet alleen door afspraken op te schrijven in een privacyconvenant, maar vooral ook door deze afspraken in de praktijk te brengen. De school heeft hierbij de regie. Deze is tenslotte verantwoordelijk voor de zorgvuldige omgang met de persoonsgegevens van de leerlingen en de communicatie met ouders. Het maken van goede afspraken met aanbieders van digitale producten en diensten hoort daarbij.
De invoering van de Algemene Verordening Gegevensbescherming (AVG) brengt mee dat onderwijsinstellingen en leveranciers vanaf 25 mei 2018 verwerkersovereenkomsten moeten hebben afgesloten die voldoen aan de eisen in de AVG. In maart 2018 zijn daarvoor de afspraken met betrekking tot de omgang van gegevens over onderwijsdeelnemers tussen onderwijsinstellingen en leveranciers herzien. Bij deze afspraken die vastgelegd zijn in het Convenant Digitale Onderwijsmiddelen en Privacy 3.0, hoort de model verwerkersovereenkomst 3.0. Deze model verwerkersovereenkomst voldoet aan de eisen van de AVG.
Bij onderwijsinstellingen en leveranciers leven uiteenlopende praktische vragen over het vervangen van bestaande bewerkersovereenkomsten en het gebruik van de nieuwe model verwerkersovereenkomst. Onderstaand zijn belangrijke uitgangspunten ten aanzien van de vervanging van bewerkerscontracten en het gebruik van de model verwerkersovereenkomst opgenomen.
Het gaat bij de bovenstaande punten om uitgangspunten. Het kan zijn dat vanwege specifieke omstandigheden partijen in onderling overleg afwijkende afspraken moeten maken.
